The recent confrontation in Ondo State between operatives of the Nigeria Security and Civil Defence Corps (NSCDC) and a local gas vendor has ignited a familiar debate in the public square: Is the government being unnecessarily harsh on small businesses, or are these enforcement actions a necessary evil to prevent catastrophe? At the heart of the tension lies a critical distinction that often gets blurred in the heat of the moment—the difference between bureaucratic wickedness and the cold, hard logic of public safety.
To the casual observer, the image of a gas seller being arrested or having his equipment confiscated feels like an assault on the "survival instinct" of the common man. However, a deeper examination of the regulatory landscape and the physics of Liquefied Petroleum Gas (LPG) reveals that these laws are not designed to stifle business, but to prevent the all-too-frequent tragedies that occur when explosive substances are traded in volatile environments.
The Physics of Fire: Why Gas is Not Kerosene
To understand the strict enforcement, one must first understand the product. Cooking gas (LPG) is fundamentally different from other household fuels like kerosene or charcoal. It is a highly volatile hydrocarbon stored under immense pressure. When released, it turns into vapor that is heavier than air. This means it does not dissipate easily; instead, it sinks and accumulates in low-lying areas, waiting for a spark.
According to the Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA), the safe handling of LPG requires specific environmental conditions that the average roadside market stall simply cannot provide. The NMDPRA’s Safety Guidelines stipulate that LPG retail outlets must be situated in locations free from sources of ignition and must have adequate ventilation to prevent gas accumulation.
When a vendor operates in a congested local market or a residential building, they are essentially creating a ticking time bomb. A single electrical spark from a nearby generator, a lit cigarette, or even the switching on of a ceiling fan can trigger an explosion. This is not a theoretical risk. In 2020, a tragic gas explosion at a residential building in Abule-Ado, Lagos, claimed over 20 lives and destroyed property worth billions. While that incident involved an industrial gas plant, it underscored the devastating consequences of LPG mismanagement in populated areas.
The Illegality of "Decanting" in Residential Zones
One of the primary reasons enforcement agencies like the NSCDC target local resellers is the dangerous practice of "decanting"—the transfer of gas from a large cylinder into smaller ones using homemade techniques rather than licensed filling machines. This practice is explicitly illegal under Nigerian petroleum regulations.

Speaking on the dangers, the Lagos State Government has previously warned against what it calls "errant gas plant operators." In a statement following a crackdown, the Commissioner for Special Duties and Intergovernmental Relations, Mr. Tayo Bamgbose-Martins, emphasized that the government’s aim was to
prevent the ugly incident of fire outbreaks... through the enforcement of safety standards across all LPG plants in the state.He noted that many of these operators lack basic safety equipment like fire extinguishers, making them a hazard to the community.
When a local reseller decants gas in the middle of a neighborhood, they are not just running a business; they are introducing a high-risk industrial process into a space that lacks the infrastructure to contain an accident.
Differentiating Enforcement from Wickedness
So, where does the perception of "wickedness" come from? It stems from the often-abrasive execution of these laws. When armed officers swoop down on a petty trader and seize his only means of livelihood without immediate recourse or explanation, it feels like persecution. Human rights groups, such as the Take It Back Movement which condemned the Ondo incident, argue that there is a "humane way" to enforce these laws.
However, the regulator’s stance is that the law must be swift because the danger is imminent. The NSCDC, in its defense of the Ondo operation, stated that the enforcement was a
routine compliance check in collaboration with the Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA).They argued that the vendors were given a chance to produce a valid license and failed to do so, and that the "minimal force" used was a reaction to resistance.
The line between wickedness and protection lies in communication and process. Wickedness would be punishing a compliant businessman out of malice. Enforcement, however, is the state's attempt to ensure that no mother loses her child because of an illegal gas shop operating under her window.
The Economic Perspective: Formalizing the Sector
It is also crucial to address the business perception. Critics argue that forcing small vendors to obtain licenses is just a way to extort money from the poor. While corruption remains a systemic issue in Nigeria, the licensing fee is legally intended to ensure accountability. A licensed operator is a traceable entity. If a gas explosion occurs, the authorities can hold the licensee accountable. An unlicensed, itinerant gas seller can simply pack up and vanish after an incident, leaving victims with no one to sue or prosecute.
The government’s position is that the gas retail business is not a "survival" trade for the ill-equipped; it is a technical trade that requires capital investment in safety gear, proper storage, and training. By enforcing these laws, the NMDPRA aims to professionalize the sector, ensuring that those who sell gas are competent to handle the enormous responsibility that comes with it.

While the methods of security operatives must always be subject to public scrutiny to prevent abuse of power, the principle behind the enforcement on gas sellers is rooted in science and tragedy. It is easy to label a government agency as "wicked" for seizing a man's gas cylinder, but that cylinder, sitting in the middle of a crowded market without a regulator, without ventilation, and without a license, is not just a tool of commerce; it is a potential weapon of mass destruction.
The real wickedness would be for the state to stand by, aware of the risks, and do nothing until the inevitable explosion occurs. The challenge for the authorities is to find a middle ground—to enforce the law without dehumanizing the traders, and to educate the public on the difference between a legitimate business and a disaster waiting to happen.
